How to Rent a Flat in Portugal as an Immigrant: Contracts, Deposits and Your Rights

Housing is one of the hardest parts of moving to Portugal, especially in Lisbon, Porto and the Algarve. Knowing the rules protects you from paying too much, or paying for something that doesn’t exist.

Where to search

  • Big portals: Idealista, Imovirtual, Casa Sapo, OLX
  • Real estate agencies (imobiliárias). In Portugal, the landlord normally pays the agent
  • Community groups, but be extra careful with scams there

What landlords usually ask for

Deposit and advance rent: the limits

  • Deposit (caução): by law it cannot be more than 2 months of rent. It must be returned at the end, minus justified damages or debts
  • Advance rent: also limited (currently up to 2 months)
In August 2026 the government sent Parliament a proposal to change several rental rules, including removing the deposit limit and allowing up to 3 months of advance rent. Until it becomes law, the current limits apply. Check the latest before signing.

The contract

  • Always sign a written contract with the landlord’s name and NIF, the rent, duration and deposit
  • The landlord must register the contract at Finanças and issue electronic rent receipts (unless legally exempt)
  • A registered contract and receipts let you deduct part of the rent in your IRS and prove your address to AIMA and banks
Rooms rented “without contract” or “without receipts” leave you with no proof of address, no IRS deduction and little protection. They can also cause problems with AIMA renewals.

Scams to avoid

  • Never pay a deposit for a flat you haven’t seen (in person or on a live video call with someone you can verify)
  • Be suspicious of prices far below the market, and of landlords who are “abroad”
  • Check who owns the property. A land registry certificate (certidão permanente) shows the owner
  • Don’t send copies of your passport to unverified people

Proving your address

Once you live there, update your address at Finanças (for your NIF), with Social Security and at AIMA. If you don’t have a contract in your name, an atestado de residência from the Junta de Freguesia can help.

Help with rent

Young people (18–35) can apply for the Porta 65 Jovem rent support programme, and there are other municipal and national supports. Check the IHRU website.
